How to maintain a bulletproof contemporaneous log under Treasury Regulation § 1.274-5T.

1. The Contemporaneous Log Requirement

Under Treasury Regulation § 1.274-5T, the IRS strictly disallows any vehicle deduction if the taxpayer fails to produce a contemporaneous log recorded at or near the time of travel. Reconstructing a log after receiving an audit notice is routinely thrown out by US Tax Courts.

2. The Non-Deductible Commuting Trap

Driving from your personal residence to your regular workplace or office is personal commuting and is 100% non-deductible. However, travel between your home and temporary client work sites, or travel between two distinct job sites during the workday, IS fully deductible.

3. The First-Year Standard Mileage Election

If you own a vehicle and want to use the standard mileage rate, you MUST choose it in the very first year the vehicle is placed in service. If you claim actual expenses (especially Section 179 or MACRS depreciation) in Year 1, you can NEVER switch to the standard mileage rate for that vehicle in subsequent years.

4. Parking Fees & Highway Tolls

The IRS standard mileage rate covers gas, oil, tires, maintenance, insurance, and vehicle depreciation. However, business-related parking fees and bridge/highway tolls are deductible separately on top of the standard mileage rate.

How to use this tool

    The 2026 business rate is 72.5¢ from 1 January and 76¢ from 1 July, so a year spanning the change has to be run twice and added.

Frequently Asked Questions

Can W-2 employees deduct business mileage on their federal taxes?

No. Under the Tax Cuts and Jobs Act (TCJA), miscellaneous itemized deductions for unreimbursed employee business expenses were suspended through 2025. W-2 employees cannot deduct mileage on federal tax returns unless their employer provides an Accountable Reimbursement Plan. Independent 1099 contractors, LLC owners, and sole proprietors continue to deduct mileage on Schedule C without restriction.

Do I need to record odometer readings for every single trip?

The IRS does not strictly mandate starting and ending odometer readings for every individual stop, provided you record the exact trip mileage, dates, origins, destinations, and specific business purposes. However, you MUST record your vehicle's beginning and ending annual odometer readings on Form 1040 Schedule C Part IV.

How does a home office affect deductible mileage?

Having a qualified home office that serves as your principal place of business under IRC § 280A is a massive tax advantage. It eliminates the "commuting trap": trips from your home office to clients, vendors, banks, or job sites are classified as business travel between work locations, making your very first and last trips of the day 100% tax deductible.
